针对部分单位对建设部第１５４号令《工程建设项目招标代理机构资格认定办法》、《工程建设项目招标代理机构资格认定办法实施意见》及《辽宁省工程建设项目招标代理机构管理实施细则》关于招标代理资格的认定标准提出的问题，我处经过研究，并对部分问题经请示建设部后，对所提问题做出如下解释： １、问：由乡镇企业局颁发的工程师证，在年度评价中是否予以承认；中级以上职称的人员是否有工程类、经济类所占总数的比例限制？答：具有工程建设类中级以上职称专职人员是指持有与工程类有关的省人事厅颁发中级以上职称证书的人员；持有经济类职称的中级以上专职人员不得超过相应资质等级标准所要求人数的２０％；参加资格延续、资格升级的招标代理机构人员必须满足要求；参加年度评价的招标代理单位对人员的要求，原则上应满足要求，但确需调整的，应说明理由，在明年的年度评价中，人员必须满足要求；参加资格延续、资格升级、年度评价的招标代理专职人员的持证上岗率均应达到７０％以上。 ２、问：招标代理机构的法定代表人是否可以兼做技术负责人？答：招标代理机构的法定代表人可以兼做技术负责人，但必须满足相关规定对技术负责人的具体要求。 ３、问：本次年度评价注册资金是否必须到位？答：参加资格延续、资格升级、年度评价的招标代理机构注册资金必须满足相应资质等级要求，本次考核必须到位。 ４、问：用B标准则乙级下降了６０００万，而暂定级下降了３０００万，与建设部１５４号令规定的有出入，能否解释？答：我省乙级、暂定级工程招标代理机构承担工程招标代理业务资格标准的制定，是结合我省招标代理机构的具体情况，从实际出发，在不脱离建设部154号令的基础上，另增设了相应的标准，分为A标准和B标准，招标代理机构在承揽代理业务时，可对两标准任选其一执行。 ５、问：国有股份制公司，控股单位为事业单位的是否可以？答：招标代理机构不得与行政机关以及有行政职能的事业单位有隶属关系或者其他利益关系。有下列情形之一的，属于与行政机关、有行政职能的事业单位以及招投标人有隶属关系或者其他利益关系：（１） 由国家机关、行政机关及其所属部门、履行行政管理职能或者存在其他利益关系的事业单位出资；（２） 与国家机关、行政机关及其所属部门、履行行政管理职能或者存在其他利益关系的事业单位存在行政隶属关系；（３） 法人代表或技术经济负责人由国家机关、行政机关及其所属部门、履行行政管理职能或者存在其他利益关系的事业单位任命。 ６、问：申请资格延续同时又准备升级的招标代理机构是否可以直接参加升级的评审？答：申请资格延续同时又准备升级的招标代理机构，应先按照资格延续的要求申报材料，通过审核给予资格延续后方可按升级的要求申报材料。 ７、问：交通局和水利局项目是否作为有效业绩？答：从事交通、水利等专业项目代理业务的，应接受行业主管理部门的监督管理，未经备案监管的招标项目，其业绩不作为考核指标。其业绩只有在企业评价和延续时有效。 ８、问：新申报暂定级单位要求从事工程招标代理业务３年以上的人员，此项标准很难达到，怎么办？答：按照建设部１５４号令规定，新申报暂定级的招标代理机构也应满足从事工程招标代理业务３年以上的人员不少于６人，按规定执行。 ９、问：没有中级以上职称的注册造价师和注册建造师是否予以认可？答：《细则》第五条已经明确：工程建设类注册职业资格人员必须具有中级以上职称，仅持有执业资格证书无中级职称人员不予认可。 １０、问：工程招标代理机构资格有效期届满，想重新申请暂定级工程招标代理机构资格的，是否可以用原来的企业名称？答：工程招标代理机构资格有效期届满，重新申请暂定级工程招标代理机构资格的，应重新申办企业营业执照，利用原企业名称再次申报的，不予受理。 １１、问：参加本次企业评价、延续、升级的，是否需要提供企业诚信评价手册？网上申报资料如何操作？答：08年４月份以前参加资格延续、升级、年度评价的招标代理机构不需要提供企业诚信评价手册，网上申报资料也暂不进行。 １２、问：具有工程建设类中级以上职称的专职人员，除法定代表人、技术负责人的变更外，其它人员的变更是否在省建设厅审批大厅办理？答：具有工程建设类中级以上职称的专职人员，除法定代表人、技术负责人的变更需要到辽宁省建设厅行政审批大厅办理外，其它专职人员的变更，要在调整变更后１５日内，持变更人员的学历证明、职称证明、劳动合同到辽宁省建设厅招投标管理处备案。 １３、问：新申请暂定级资格的招标代理机构的专职人员，原单位没交社会保险的怎么办？答：新申请暂定级资格的招标代理机构的专职人员不能提供原单位社会保险证明及人事档案代理证明和劳动合同的，应开具有关证明材料。 １４、问：０６年１２月份取得的暂定级资格，延续时业绩应满足什么条件？答：取得暂定级资格不满三年的招标代理机构，申请资格延续的业绩应满足年度累计完成金额１亿元以上。 １５、问：申请乙级资格延续，近３年累计代理额是多少？对乙级资格延续企业应提供的材料，《省细则》无明确要求，是否按建设部实施意见第一条第三款执行？答：按照建设部１５４号令规定，乙级工程招标代理机构近３年内累计中标金额在８亿元人民币以上；乙级资格延续企业应提供的材料按建设部实施意见第一条第三款执行。若对上述解释仍有不清楚的，请来函或来电询问。联系人：卜洁欣 联系电话：024－23448670二○○七年十二月二十九日
