关于做好标准施工招标资格预审文件和
标准施工招标文件贯彻实施工作的通知
国务院各部门、各直属机构，各省、自治区、直辖市及计划单列市、副省级省会城市、新疆生产建设兵团发展改革委、经贸委（经委）、财政厅（局）、建设厅（建委、局）、交通厅（局）、信息产业厅（局）、通信管理局、水利厅（局）、广播影视局，各铁路局，民航各地区管理局： 《标准施工招标资格预审文件》和《标准施工招标文件》（以下简称《标准文件》）已经国家发展改革委、财政部、建设部、交通部、铁道部、信息产业部、水利部、民航总局、广电总局联合发布，将于2008年5月1日起试行。为做好《标准文件》贯彻实施工作，现就有关问题通知如下： 一、充分认识《标准文件》颁布实施的重要意义 招标文件的编制是招标投标活动的一个重要环节。规范招标文件的编制，是进一步规范招标投标活动的重要措施。《标准文件》是国务院九部门在总结现有行业施工招标文件范本实施经验，针对实践中存在的问题，并借鉴世界银行、亚洲开发银行做法的基础上编制的。《标准文件》定位于通用性，着力解决各行业施工招标文件编制中带有普遍性和共同性的问题，规范了招标投标活动当事人的权利义务，标志着政府对招标投标活动的管理已经从单纯依靠法律制度深化到结合运用技术操作规程进行科学管理。《标准文件》的贯彻实施，对于进一步统一工程招标投标规则、提高招标文件质量、规范招标投标活动、加强政府投资管理，预防和遏制腐败，促进形成统一开放、竞争有序的招标投标市场，具有重要意义。各单位要统一思想，提高对《标准文件》发布实施重要意义的认识，统一部署、加强领导、扎实推进，确保《标准文件》贯彻实施工作高效有序进行。 二、认真组织《标准文件》的宣传、学习和培训 （一）要广泛开展宣传。各级发展改革、财政、建设、铁道、交通、信息产业、水利、民航、广电部门要结合本部门本地区情况统筹策划，充分利用报刊、杂志、网络等媒体，广泛开展形式多样的宣传活动，扩大《标准文件》的社会影响。 （二）要认真组织学习。与过去的文件和其他行业施工招标文件范本相比，《标准文件》在指导思想、体例结构、主要内容以及使用要求等方面都有较大的创新和调整。对于这些创新和调整，各部门、各地方要高度重视，认真组织学习，切实掌握《标准文件》的新规定和新要求。 （三）要做好培训工作。为保证《标准文件》正确适用，要在实施前组织广泛培训。具体组织方式分为集中培训和各部门组织培训两个层次。一是国家发展改革委负责牵头组织骨干集中培训，编制工作小组成员、成员单位所属的省级机构和计划单列市派人参加培训，参加培训的人员应具备承担培训讲课的能力。二是集中培训后，各部门和各地方可在本系统和本地方组织培训。培训的讲课人员应是参加骨干培训的人员，或由编制小组推荐的讲师担任。《标准文件》编制工作小组编写了《标准文件使用指南》，用于指导学习培训和招标人编制招标文件。 三、切实做好《标准文件》的贯彻实施 （一）要做好行业施工招标文件范本和《标准文件》的衔接。《标准文件》和行业施工招标文件范本要采取两个本子的形式，《标准文件》规定通用部分，行业施工招标文件范本规定本行业专用部分，两个本子结合起来，构成完整的施工招标文件。《标准文件》发布实施后，已有行业施工招标文件范本的成员单位，要尽快根据《标准文件》修订形成新的行业施工招标文件范本；准备编制行业施工招标文件范本的，要尽快根据《标准文件》并结合本行业施工招标特点和管理需要编制；不准备编制行业施工招标文件范本的，要按照《<标准施工招标资格预审文件>和<标准施工招标文件>试行规定》（以下简称《试行规定》）的要求使用《标准文件》。 （二）要选择好试点项目。各级人民政府有关部门要根据本部门、本地方实际情况，尽早选取一些具有一定规模的政府投资工程项目作试点，试点时间初步确定为一至两年。条件成熟的，可以全面推开。 （三）要严格按照规定使用《标准文件》。《试行规定》对施工招标试点项目招标人编写施工招标资格预审文件和施工招标文件、资格申请人和投标人编写资格预审申请文件和施工投标文件，以及评审委员会和评标委员会作出了具体规定，各方当事人要严格按照《试行规定》执行。《标准文件使用指南》对《标准文件》有关规定的编制目的、具体内容和有关行业特殊要求做了进一步说明，各方当事人在适用《标准文件》过程中，要充分参考使用《标准文件使用指南》。 （四）要做好《标准文件》和《标准文件使用指南》的发布和发行工作。为方便社会各界阅读使用《标准文件》，在各成员单位门户网站和《中国采购与招标网》上公布《标准文件》电子文本，供社会主体免费下载使用。为保证《标准文件》文本的统一性，指定中国计划出版社出版的《标准文件》为书面正式文本。电子文本和书面正式文本内容不一致的，以书面正式文本为准。各成员单位要充分利用本部门发行渠道，做好《标准文件》和《标准文件使用指南》的发行工作。 （五）要做好指导和监督检查。选择试点的部门要加强对试点项目招标人使用《标准文件》的指导和监督检查，并对如何适用《标准文件》中不加修改地引用的内容作出解释。试点结束后，国家发展和改革委员会会同国务院有关部门对《标准文件》中不加修改地引用的内容作出解释或调整。 四、密切跟踪反馈《标准文件》的试行情况 要做好试点情况跟踪反馈工作，为全面推行《标准文件》做好准备。选择试点的部门要密切跟踪试点项目适用《标准文件》的情况。《标准文件》试行过程中，欢迎社会各界反映问题。试点项目招标人在适用《标准文件》中出现的问题，向选择试点的部门反映。选择试点的部门应当及时将问题向主管本行业的成员单位反馈。非试点项目的招标投标当事人和其他社会主体在使用《标准文件》中发现的问题，向主管本行业的成员单位反映。各成员单位要将本系统试点项目的选取及情况跟踪情况，及时向编制工作小组办公室反映（联系电话：010-68502510，电子邮箱：limaon@ndrc.gov.cn）。编制工作小组定期召开会议，研究试行中出现的问题及应对措施，对《标准文件》作进一步完善，为全面推行《标准文件》作好准备。
